MAR Apart Hotel respects your privacy. This policy explains what personal data we collect through this website, what we use it for and how you can exercise your rights, in accordance with Peru's Personal Data Protection Law (Law No. 29733) and its regulations.
1. Data controller
The owner of the personal data bank and the party responsible for processing it is GTR del Perú S.A.C. (tax ID/RUC 20614981858), with its registered address at Psj. Ramón Castilla Mz. N Lote 2, Casma, Áncash. For any question about your data, you can write to us at [email protected].
2. What data we collect
We only collect the data you give us when you fill in the forms on this site:
- Identification and contact details: first and last names, email address, mobile or phone number, country and, where applicable, the type and number of your ID document.
- Details of your request: arrival and departure dates, number of guests, accommodation category, estimated arrival time and any comments you send us.
- Company details, when you request an event or a corporate rate: company name, tax ID (RUC), industry and event details.
- Complaints Book details: the information required by consumer protection rules to record and answer your claim or complaint.
For security purposes, we also store the IP address each form is sent from in pseudonymized form (as an irreversible hash, not the IP itself), along with basic technical browser data. We do not ask for sensitive data or for card or bank account details through this site.
3. How we use your data
We process your data only to:
- Handle your booking requests and confirm availability, rates and conditions.
- Reply to your event and corporate rate requests, your questions and your suggestions.
- Record, handle and answer claims and complaints filed in the Complaints Book, as required by law.
- Contact you by email, phone or WhatsApp about your request.
- Protect the site against automated or abusive submissions.
If you give us your separate consent, we may also send you news and promotions from the hotel. You can withdraw it at any time, and this will not affect how we handle your requests.
4. Consent and required data
We process your data with the consent you give us when you send a form after reading this policy, and because it is necessary to handle what you ask us for. Complaints Book data is also processed to comply with a legal obligation.
Fields marked as required are needed to handle your request: if you do not provide them, we will not be able to process it.
5. Who we share your data with
We do not sell or transfer your personal data. We only share it, when necessary, with the providers that help us run this site and communicate with you (for example, web hosting and email services), who process it on our behalf, and with the authorities when a law or a court order requires it.
Some of these providers may be located outside Peru; in that case, the transfer is carried out in accordance with Law No. 29733 and its regulations.
6. How long we keep your data
We keep your data for as long as it is needed to handle your request and for the periods required by applicable rules, such as those governing the Complaints Book. After that, we delete or anonymize it.
7. Your rights
You can exercise your rights of information, access, rectification, cancellation and objection (known in Peru as ARCO rights) at any time, and you can also withdraw your consent.
To do so, write to us at [email protected] with the subject line “Personal data protection”. Include your full name, the right you wish to exercise and your specific request, and attach a copy of your ID document (or of the document proving your authority, if you are acting on behalf of someone else). We will reply within the time limits set by current regulations.
If you believe we did not handle your request properly, you may file a claim with Peru's National Authority for Personal Data Protection (Autoridad Nacional de Protección de Datos Personales), part of the Ministry of Justice and Human Rights.
8. Security
We apply reasonable technical and organizational measures to protect your data against loss, misuse or unauthorized access. Access to the information is restricted to authorized hotel staff.
9. Cookies
This site only uses technical cookies, which are needed for it to work securely (for example, to protect forms against fraudulent submissions). We do not use advertising cookies.
You can block or delete cookies in your browser settings, although some features of the site, such as sending forms, may stop working.
10. Minors
If you are under 18, please ask your parent or legal guardian to send the request for you or to authorize it. In the Complaints Book, a minor's details are recorded together with those of their parent or legal guardian.
11. Changes to this policy
We may update this policy to reflect legal changes or changes to our services. The version in force is always the one published on this page, with its last updated date.
